Terms and Conditions

Independent Escrow Services, Inc. (“IES”), and the User agrees as follows:

  1. Service Provider 

IES services are provided by, and you’re contracting with:

Independent Escrow Services, Inc.

A corporation existing under the laws of the State of Illinois, operating under the laws of the State of Illinois, and operating as an Independent Escrowee, under the Illinois Title Insurance Act.

  1. Acceptance of Terms and Conditions 

By signing up, you agree to use IES as the escrow provider for any purchase of real property who’s address falls within the Service Area during the period in which the “Salute to Service” promotion is active. IES is obligated to provide you with a discount off their escrow services, based on their current rate card, for any closing that occurs prior to published program end date.

  1. Service Area 

IES reserves the right to refuse to close any transaction that occurs outside of the geographic scope in which it traditionally provides escrow services.

  1. Representations and Warranties 

By signing these Terms and Conditions, the user represents and warrants that they are currently or were formerly a First Responder or Service Member. A First Responder or Service Member including the following occupations: a service member in one of the armed forces, Veterans, a Police Officer from any municipality, a Firefighter from any municipality, Nurses, EMS Professional from any municipality, 911 dispatchers, etc. Upon a reasonable request from IES, the user agrees to provide proof through employment records of their qualification for this program.

  1. Default 

In the event of a default by User, IES is entitled to all remedies at law or equity including but not limited to expectation damages, specific performance, attorneys fees and court costs.

In the event of a default or a court of competent jurisdiction deems that there is a breach of the Terms and Conditions, the User is limited to the amount of the discount as liquidated damages. User shall be deemed to have waived all other claims for damages or relief at law or equity.

  1. Notices 

All notices, statements or other documents which are required or contemplated by these Terms and Conditions shall be in writing and delivered by electronic mail, to the electronic mail address most recently provided to such party or such other electronic mail address as may be designated in writing by such party.

  1. Applicable Law 

This Terms and Conditions shall be construed in accordance with and governed by the laws of the State of Illinois without regard to the principles of conflicts of law.
